Terms of Service

Welcome to Kernel. These Terms of Service ("Terms") govern your use of the Kernel website at kernel.film and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Kernel is a free movie recommendation and exploration tool. It lets you browse and search movies, view metadata, save a personal watchlist, and explore a 2D map of films generated from content-based similarity. Movie metadata and images are provided by TMDb. Kernel is not endorsed or certified by TMDb.

2. Accounts

You may create an account using an email address and password. You are responsible for keeping your password confidential and for all activity under your account. You agree to provide an accurate email address and to notify us if you suspect your account has been compromised. You must be at least 13 years old to use the Service.

3. Acceptable use

You agree not to:

  • Use the Service in a way that violates any law or infringes anyone's rights.
  • Scrape, crawl, or bulk-download content from the Service, or otherwise place unreasonable load on our servers.
  • Attempt to break, probe, or circumvent the security or rate limits of the Service.
  • Reverse engineer, decompile, or tamper with the Service except where permitted by law.
  • Use the Service to transmit malware or abusive content, or to harass others.
  • Access the Service through automated means without our written permission.
  • Use the Service to train machine-learning models on Kernel-generated outputs without our written permission.

4. Content and intellectual property

Movie titles, posters, descriptions, cast, and related metadata are the property of their respective rights holders and are provided via the TMDb API. Your use of that material is subject to TMDb's terms. The Kernel name, logo, site design, source code, and algorithmically generated outputs (including recommendations and explorer coordinates) are owned by the operator of Kernel and are protected by applicable law.

You retain ownership of your watchlist and any data you add to your account. You grant us a limited license to store and process that data solely to provide the Service to you.

5. Recommendations are opinions

Kernel's recommendations, scores, and explorer coordinates are generated by content-based algorithms. They are provided for exploratory and entertainment purposes only and should not be treated as authoritative, comprehensive, or personalized professional advice.

6. Availability and changes

We may add, change, or remove features of the Service at any time. We may also suspend or discontinue the Service in whole or in part. We will try to give reasonable notice of material changes where practical, but we are not required to do so.

7. Termination

You may stop using the Service at any time and request deletion of your account by emailing us. We may suspend or terminate your access if we reasonably believe you have violated these Terms, placed the Service at risk, or otherwise caused harm to other users or to us.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that movie information will be accurate or complete.

9. Limitation of liability

To the maximum extent permitted by law, Kernel and its operator will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars (US$100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Kernel and its operator from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to its conflict-of-law rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
